How Close It Actually Got

Closer than the headline votes suggest. SB 118 initially failed in the Senate 19-20 before passing 19-17 on reconsideration. HB 161 passed the House 67-30, also on reconsideration.

Each chamber then amended and passed the other’s bill, SB 118 clearing the House 70-29 and HB 161 clearing the Senate 21-17 on March 4. Each chamber then rejected the other’s revised version, sending both to conference.

A conference committee of three members from each chamber produced a final version. It never returned to either floor before the session adjourned on March 14.

A separate standalone sweepstakes ban bill also failed to clear the Senate that session.

What the Ban Would Have Done

Both bills defined sweepstakes platforms using dual-currency systems as illegal internet gaming, carrying a civil penalty of up to $100,000 for a first offence and up to $250,000 for each subsequent one.

Those penalties targeted operators rather than players. The practical effect for Virginia players would have been simultaneous loss of access as platforms exited ahead of any enforcement date.

Why 2027 Matters More Than It Looks

Both bills carried a reenactment clause requiring the legislature to pass them again in 2027 before they could take effect. Even success in 2026 would not have changed anything immediately.

The reconciled version moved forward with HB 161’s reenactment clause and a January 2028 regulatory deadline. Any Virginia iGaming launch was always a 2028 proposition at the earliest.

The 2027 session is the next opportunity. If lawmakers resolve the revenue-allocation dispute, a sweepstakes ban very likely rides along with the fix.

Who Wanted the Ban

Virginia licenses five land-based casinos. Rivers Casino Portsmouth, Hard Rock Bristol, and Caesars Virginia are operating, with Norfolk and Petersburg under construction.

Those operators would have received the iGaming licences the bills created, each able to partner with up to three online operators under a 20% tax on adjusted gross gaming revenue.

An iGaming monopoly is worth considerably more without unlicensed sweepstakes competition. That alignment of interests is why the ban was attached to the legalisation bill rather than filed alone.
